I’ve been holding onto this article for a while so as to not disturb the happy holidays with thoughts about the scum and filth that inhabit our US health care system, attacking everything that competes with drugs, drugs, drugs, and more drugs.  But, Thanksgiving and Christmas are now behind us.  The turkey is gone, the family units are back in their own nests, and its time to catch up.

For thirty-one months, now, in the Doctor’s Data v Barrett Federal Court case, we’ve been watching Stephen Barrett try desperately to delay the inevitable demise of his quackwatch operation.

He’s failing.

The other Defendants in the case, the National Council Against Health Fraud Inc (NCAHF), and Quackwatch, Inc. are VERY, VERY worried – and they certainly should be, for nothing is going their way.

I know.  I know.

I’d be the perfect person to go look at Stephen Barrett‘s Tax Returns with Doctor’s Data’s attorneys in the Doctor’s Data v Barrett, Federal Court case.   But, I just can’t do it.

It’s not because I’m busy, and I am.  It’s because once I had any active role in the case Barrett’s attorneys would use that to try and silence me writing further articles about the situation.  They’d simply claim that anything I wrote in the future was related to Barrett’s Tax Returns, blah, blah, blah…  And, the judge has ordered that, so far, the information the attorneys find in those Tax Returns from the year 2000 through the present, must stay within the court, and not be publicly revealed. As I pointed out in my last article “Part One – The Privilege Removal” Doctor’s Data had filed TWO SEPARATE Motions to Compel in the Doctor’s Data v Barrett case, asking the judge to issue a court Order forcing Barrett and the others to comply with Discovery demands.

The judge quickly, and with gusto, issued his first Order, making it very clear that he wanted Barrett and his legal team to quit screwing around and start complying with simple court procedures – or else.

Every entity develops a personality, and a life, of its own.  Public agencies are no exception.  Sometimes an entity develops so negatively that there is simply no point in saving it.  There is virtually nothing worth keeping.  The Maryland Board of Physicians is one of those entities.

The problem is that every State needs to regulate certain kinds of health professionals – specifically those that, because of their offerings, can seriously damage consumers.  But sometimes, as in the case of the Maryland Board of Physicians the seeming solution becomes worse than the problems it is there to prevent. Wednesday, July 25th, 2012, the Maryland Board of Physicians played its last card in its organized assault against Mark and David Geier.  They had their last meeting to decide the Geiers’ fate, so to speak.

But no matter what their decision is about the Geiers, it is of no importance whatsoever.  For this last act, this meeting, is the finale of the situation controlled by the Maryland Board of Physicians.  To this point members, and employees, of the Board controlled the process, and the information flow, using what is known as an Administrative Procedure.
